LMIA Work
Permit in Canada: What It Is and How It Works
Canada is
a country that welcomes foreign workers who have the skills and experience that
are in demand in the Canadian labor market. If you are a foreign worker who
wishes to work in Canada, you may need a LMIA (Labor Market Impact Assessment)
Work Permit. In this article, we will explain what a LMIA Work Permit is, how
it works, and what you need to do to apply for one.
What is a LMIA Work Permit?
A LMIA Work Permit is a type of work permit that is issued to foreign workers who have a job offer from a Canadian employer that has been approved by the government. The LMIA is a document that is issued by Employment and Social Development Canada (ESDC) to employers who want to hire foreign workers. The purpose of the LMIA is to ensure that the hiring of a foreign worker will not have a negative impact on the Canadian labor market.
In order to obtain a LMIA Work Permit, the Canadian employer must first apply for a LMIA from ESDC. The employer must demonstrate that they have made reasonable efforts to hire Canadian citizens or permanent residents for the job, but were unable to find a suitable candidate. They must also provide evidence that hiring a foreign worker will have a positive impact on the Canadian labor market, such as by creating jobs or transferring skills to Canadians.
Once the LMIA is approved, the employer will provide the foreign worker with a copy of the LMIA, which the worker must include in their application for a LMIA Work Permit.
How does a LMIA Work Permit work?
A LMIA
Work Permit allows a foreign worker to work in Canada for a specific employer
and for a specific period of time. The length of the work permit will depend on
the duration of the job offer and the length of time for which the LMIA was
approved. In general, LMIA Work Permits are issued for a maximum of two years.
The
foreign worker must meet certain eligibility requirements to obtain a LMIA Work
Permit. These requirements include:
- Having a valid job offer from a Canadian employer that has been approved by ESDC
- Meeting the qualifications and experience required for the job
- Meeting the health and security requirements for entry into Canada
- Being able to demonstrate that they will leave Canada at the end of their authorized stay
- In
addition, the foreign worker may be required to obtain a Temporary Resident
Visa (TRV) in order to enter Canada, depending on their country of citizenship.
How to apply for a LMIA Work Permit
To apply for a LMIA Work Permit, the foreign worker must first obtain a copy of the approved LMIA from their Canadian employer. They must then submit an application for a work permit to Immigration, Refugees and Citizenship Canada (IRCC), along with supporting documentation such as their passport, educational and work experience documents, and proof of financial support. The application can be submitted online or by paper, and the processing time will depend on the country from which the application is submitted.
